These Terms and Conditions ("Terms") govern your use of www.thefruik.com ("Site"), operated by Taru Essentials LLP, registered under the Limited Liability Partnership Act, 2008 ("Company," "we," "us," or "our"). By browsing, registering, or purchasing on the Site, you agree to be bound by these Terms and our Privacy Policy.

If we make a substantial change to these Terms — one that meaningfully reduces your rights or increases your responsibilities — we will notify you at least 30 days in advance via your registered contact details. We recommend reviewing these Terms periodically.

The Fruik provides customers with access to purchase essential oils, cold-pressed oils, aroma diffusers, ultrasonic mosquito repellers, and related wellness products at prices displayed on the Site.

Product availability, pricing, and specifications are subject to change without prior notice. We reserve the right to limit quantities or discontinue any product at our sole discretion.

Your right to use this Site is personal and non-transferable. You are responsible for keeping your login credentials confidential. We strive to keep the Site available 24/7, but access may be interrupted for maintenance or due to circumstances beyond our control.

You agree not to misuse the Site, including but not limited to:

• Uploading viruses, malicious code, or harmful content
• Scraping, data-mining, or using bots on the Site
• Bypassing security measures or unauthorised access attempts
• Impersonating any person or entity
• Publishing defamatory, obscene, or unlawful content

The Company reserves the right to modify, suspend, or discontinue any feature of the Site at any time without notice.

You must not submit content that is harmful, defamatory, obscene, infringing, or in violation of any applicable law. We reserve the right to remove non-compliant content without prior notice.

As a condition of purchase, you consent to receive transactional and promotional communications from us. You may opt out of promotional emails at any time via the unsubscribe link included in each email.

All prices displayed on the Site are inclusive of applicable GST. The GST rate applied to your order will reflect the combined state and central tax rates applicable to your shipping destination.

In the event of a pricing error, we reserve the right to either contact you for confirmation or cancel your order and issue a full refund. If payment has already been processed, the amount will be reversed to your original payment method.

Delivery charges, if applicable, will be displayed at checkout and are in addition to the product price.

Cancellations by The Fruik: We reserve the right to cancel any order at our discretion due to pricing errors, product unavailability, quality issues, or suspected fraud. If payment has been processed, a full refund will be issued to your original payment method.

Cancellations by You: We will attempt to honour cancellation requests received before an order has been processed or dispatched. Once an order is in processing or has shipped, cancellation is not possible.

Pre-orders: Cancellations and exchanges are not applicable on pre-order purchases. If a pre-order cannot be fulfilled, a full refund will be processed within 5–7 business days.

Sale items: Items purchased during a sale or festive offer are not eligible for return, exchange, or cancellation.

You agree to use only valid payment methods that you are lawfully authorised to use. By submitting payment details, you confirm that all information provided is accurate.

We monitor accounts for fraudulent activity. Users found to be engaging in fraud — including operating multiple accounts or making unauthorised transactions — may have their accounts terminated immediately and may be subject to legal proceedings.

Your payment card details are processed securely and will not be shared with any third party except where required for fraud verification or by applicable law.

Most orders ship within 1 business day and are delivered within 4–5 days of ordering. We do not ship on Sundays or public holidays.

Estimated delivery times are indicative and may be affected by courier delays, weather disruptions, force majeure events, or other circumstances beyond our control. The Fruik is not responsible for third-party delivery delays.

If you specify a third-party recipient (e.g. as a gift), delivery to the address provided constitutes fulfilment of our obligation. We are not responsible for packages redirected or delayed due to custom delivery options selected by the customer.

We may, in rare circumstances, be unable to fulfil a confirmed order due to stock unavailability, supplier failure, or quality issues identified during our audit process. In such cases, no damages or compensation will be payable, but any amount paid will be fully refunded.

The Site and all products and services are provided on an "as is" and "as available" basis, without warranties of any kind — express or implied — including merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We make every effort to display product colours and details accurately, but we cannot guarantee that your device screen will reflect exact colours.

We do not endorse or take responsibility for the accuracy of any third-party content, linked websites, or external services accessible via the Site.

To the fullest extent permitted by law, The Fruik and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or opportunity — arising out of your use of the Site or any products purchased through it.

Where liability cannot be excluded under applicable law, our total liability to you shall not exceed the amount paid by you for the specific order giving rise to the claim.

All content on the Site — including text, images, graphics, logos, software, audio, and video — is the property of Taru Essentials LLP or its licensors and is protected under applicable copyright and trademark laws.

You may not reproduce, distribute, modify, publish, or commercially exploit any content from the Site without our prior written permission. You may download or print content for your own personal, non-commercial use only.

The Fruik name, logo, and all associated marks are proprietary trademarks of Taru Essentials LLP. Unauthorised use is strictly prohibited.

• Gift cards are valid until the expiry date stated on the card. Validity cannot be extended and expired cards cannot be replaced.
• Gift cards are non-transferable and cannot be redeemed for cash, refunded, or substituted.
• If your purchase exceeds the gift card value, you must pay the balance via another payment method.
• Resale of gift cards is strictly prohibited.
• Lost or stolen gift cards will not be replaced.
• Gift cards may not be used in connection with any marketing or advertising activity without prior written approval.
• The Fruik is not liable for unauthorised use of gift cards. The person presenting the card is assumed to be the intended recipient.
• These Gift Card Terms are in addition to, and not in replacement of, these general Terms and Conditions.

• Discount codes apply to the total cart value unless stated otherwise.
• Only one discount code may be applied per order. Codes cannot be combined with other offers or promotions.
• Discount codes cannot be used in conjunction with gift cards.
• We reserve the right to withdraw or modify any offer at any time without prior notice.

You agree to indemnify and hold harmless The Fruik (Taru Essentials LLP), its directors, officers, employees, and agents from and against any claims, damages, losses, penalties, or legal costs arising from:

• Your breach of these Terms or the Privacy Policy
• Your violation of any applicable law or regulation
• Your infringement of any third-party rights
• Any misuse of your account by you or any third party

Any dispute arising from your use of the Site or these Terms shall first be attempted to be resolved informally by contacting us at hi@thefruik.com.

If informal resolution is not possible, the dispute shall be referred to a sole arbitrator identified by the Company. Arbitration shall be conducted in English under the Arbitration & Conciliation Act, 1996, with the seat of arbitration in Kanpur, Uttar Pradesh.

These Terms shall be governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, exclusive jurisdiction for any legal proceedings shall vest in the courts at Kanpur, Uttar Pradesh, India.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
